To bring an action for divorce in South Carolina, the Plaintiff must have resided here for more than one year, or, if the Plaintiff is a non-resident, then the Defendant must have resided here for more than one year. If both parties live here, then the Plaintiff must have been a resident for three months.

There are five grounds for divorce in South Carolina. The four fault grounds are adultery, habitual drunkenness or drug abuse, physical cruelty, and desertion. A party who requests a divorce on a fault ground is entitled to ask the Court to grant the divorce three months after the date the Complaint is filed.

For a no-fault divorce, the couple must have lived separate and apart for more than one year. "Separate and apart" means separate residences, not separate bedrooms in the same house.
